Terms of Use

These Terms of Use (“Terms”) govern your use of BuySellDuplex.com (the “Site”), operated by Carole Wehner and Milwaukee Executive Realty, LLC, a Wisconsin limited liability company (“we,” “us” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Real estate brokerage

Carole Wehner is a licensed real estate broker affiliated with Milwaukee Executive Realty, LLC, 2266 N. Prospect Ave., #600, Milwaukee, Wisconsin 53202. Using the Site, submitting a form or contacting us does not by itself create a brokerage, agency or client relationship. Any brokerage services will be provided under the disclosures and written agreements required by Wisconsin law, including the Wisconsin broker disclosure to customers and, where applicable, a written buyer agency or listing agreement.

2. Listing information (IDX)

Property listing information on the Site is provided through the Internet Data Exchange (IDX) program of Metro MLS. Listings held by brokerage firms other than Milwaukee Executive Realty, LLC are identified with the listing firm’s name. IDX information is provided exclusively for consumers’ personal, non-commercial use, and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.

Listing information, including prices, rents, income and expense figures, square footage, lot size, taxes, school assignments and availability, is supplied by sellers, listing brokers and other third parties. It is deemed reliable but is not guaranteed and should be independently verified. Properties may be under contract, sold or withdrawn and still appear on the Site for a time. Copyright © Metro MLS. 3. Calculations, census data and general information

Cap rates, gross rent multipliers, price-per-unit figures and similar calculations on the Site are computed from the figures in a listing and are provided for convenience only. Community statistics come from the U.S. Census Bureau’s American Community Survey, which is based on samples and carries margins of error; figures for Milwaukee neighborhoods combine census tracts and are approximate. This product uses the Census Bureau Data API but is not endorsed or certified by the Census Bureau. Examples on the Site are illustrative only.

Nothing on the Site is legal, tax, accounting, lending, appraisal, engineering or investment advice. Real estate investments involve risk, including the loss of money. Before buying or selling, consult your own attorney, tax adviser, lender, inspector and other qualified professionals.

4. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) copy, scrape, harvest, frame, resell or redistribute listing data or other content, including by automated means such as bots, spiders or crawlers (other than search engines indexing the Site in the ordinary course); (c) submit false, misleading, spam or automated form submissions, or impersonate another person; (d) attempt to probe, scan, disrupt, overload or gain unauthorized access to the Site, its servers or databases, or circumvent its security features; or (e) upload or transmit malicious code. We may block access to anyone who violates these Terms.

5. Saved properties

The “save” (heart) feature stores your selections in your own browser. Saved properties may disappear if you clear your browser data, use another device, or if a listing is sold or withdrawn.

6. Intellectual property

The Site’s text, design, graphics, photographs and code are owned by us or our licensors and are protected by copyright and other laws. Listing content belongs to Metro MLS and its participants. You may view and print pages for your personal, non-commercial use; any other use requires our written permission.

7. Third-party links and services

The Site links to and uses services from third parties, such as map providers, municipal websites and the Census Bureau. We are not responsible for their content, accuracy, availability or privacy practices.

8. Fair housing

Milwaukee Executive Realty, LLC is committed to the letter and spirit of federal, Wisconsin and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other characteristic protected under federal law, the Wisconsin Open Housing Law or applicable local ordinances, including those of the City of Milwaukee.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER CAROLE WEHNER, MILWAUKEE EXECUTIVE REALTY, LLC, METRO MLS, NOR THEIR OWNERS, AGENTS, EMPLOYEES OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation does not limit any duties owed under a separate written brokerage agreement or under Wisconsin real estate license law.

11. Indemnification

You agree to indemnify and hold harmless Carole Wehner and Milwaukee Executive Realty, LLC from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site.

12. Governing law and venue

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. You agree that any legal action or proceeding relating to the Site or these Terms shall be brought exclusively in the state courts located in Milwaukee County, Wisconsin, or, where federal jurisdiction exists, the United States District Court for the Eastern District of Wisconsin, and you consent to the personal jurisdiction of those courts.

13. Changes and termination

We may change these Terms, or change, suspend or discontinue any part of the Site, at any time. The effective date above shows when these Terms were last updated, and your continued use of the Site after a change means you accept the updated Terms.

14. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site; they do not replace any separate written brokerage agreement.
